{"id":34350,"date":"2021-04-22T19:11:31","date_gmt":"2021-04-23T02:11:31","guid":{"rendered":"https:\/\/lapost.us\/?p=34350"},"modified":"2021-04-22T19:11:31","modified_gmt":"2021-04-23T02:11:31","slug":"acting-ftc-chair-blasts-supreme-court-decision-limiting-agency-consumer-power","status":"publish","type":"post","link":"https:\/\/lapost.us\/?p=34350","title":{"rendered":"Acting FTC chair blasts Supreme Court decision limiting agency consumer power"},"content":{"rendered":"<p>Acting Federal Trade Commission (FTC) Chairwoman\u00a0Rebecca Kelly Slaughter\u00a0criticized the Supreme Court\u2019s unanimous decision Thursday to limit the agency\u2019s ability to secure monetary relief for consumers from companies found to engage in deceptive practices.<\/p>\n<p>The court&#8217;s opinion, delivered by Justice Stephen Beyer, said that the FTC\u2019s authority under a provision known as Section 13(b) does not grant the agency the ability to obtain equitable monetary relief.<\/p>\n<p>Slaughter said the ruling took away the FTC\u2019s \u201cstrongest tool\u201d to help consumers and urged Congressional action.<\/p>\n<p>\u201cIn AMG Capital, the Supreme Court ruled in favor of scam artists and dishonest corporations, leaving average Americans to pay for illegal behavior,\u201d Slaughter\u00a0<a href=\"https:\/\/click1.email.thehill.com\/eptpjvdlqrrfcvcrftbqqfppqdfwrdrkkhqlvzwrrhsbyr_srpbmmvrvtbkbpbrpcck.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/click1.email.thehill.com\/eptpjvdlqrrfcvcrftbqqfppqdfwrdrkkhqlvzwrrhsbyr_srpbmmvrvtbkbpbrpcck.html&amp;source=gmail&amp;ust=1619218527312000&amp;usg=AFQjCNHOnReaHSj8bcdR1gbm9zcs2ddbig\">said in a statement<\/a>\u00a0on the case, AMG Capital Management v. FTC.<\/p>\n<p>Breyer\u00a0<a href=\"https:\/\/click1.email.thehill.com\/zdpdvgzjfrrkcgcrkbsffkddfzkqrzrttlfjgwqrrlmspm_srpbmmvrvtbkbpbrpcck.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/click1.email.thehill.com\/zdpdvgzjfrrkcgcrkbsffkddfzkqrzrttlfjgwqrrlmspm_srpbmmvrvtbkbpbrpcck.html&amp;source=gmail&amp;ust=1619218527312000&amp;usg=AFQjCNGk5xufDi-5qLktMi95N37Irvfz2w\">wrote<\/a>\u00a0that the court\u2019s ruling does not prohibit the FTC from using other provisions of the law to seek restitution, and that the commission can ask Congress to \u201cgrant it further remedial authority.&#8221;<\/p>\n<p>Slaughter and other commission members are doing just that.
