they won\u2019t have to worry about losing business to a competitor pretending to have a lower price to lure consumers onto their lot, but then charging much more once the consumer gets there.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\">\n<div class=\"td-video-replacer\" data-id=\"undefined\"><\/div>\n<div class=\"youtube-embed\" data-video_id=\"RJBdKh01oUo\"><iframe loading=\"lazy\" id=\"widget2\" title=\"FTC Implements Protections for Car Buyers with Limited English Proficiency\" src=\"https:\/\/www.youtube.com\/embed\/RJBdKh01oUo?feature=oembed&amp;enablejsapi=1\" width=\"100%\" height=\"392\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div><figcaption class=\"wp-element-caption\"><em>Malini Mithal, associate director, Division of Financial Practices, Federal Trade Commission, explains the language component of the FTC\u2019s new Combating Auto Retail Scams Rule (CARS).<\/em><\/figcaption><\/figure>\n<p>The CARS Rule makes this happen four ways, Mithal continued: first, dealers can\u2019t lie about key information like costs, financing terms, add ons and rebates; second, dealers must tell consumers the total price of the car (e.g. the full price of a 10-year contract, not just the first few monthly payments); third, dealers can\u2019t charge junk fees that don\u2019t benefit the consumer (e.g. a second warranty with no coverage, or oil change add-ons incompatible with an electric car); and fourth, \u201cDealers can only charge for things if consumers know what the charge is for and agree to pay for it \u2014 so no more hidden costs in contracts.\u201d<\/p>\n<p>The rule also requires dealers advertising a car in a certain language, like Spanish, to clearly disclose any added costs in that same language \u201cso buyers know what they\u2019re agreeing to,\u201d said Jamie Brooks, an attorney with the FTC\u2019s Division of Financial Practices.<\/p>\n<h2 class=\"wp-block-heading\">Why bait-and-switch?<\/h2>\n<p>The CARS Rule focuses so much on bait-and-switch tactics because of how many actions the FTC has brought against it, \u201cwhere dealers advertise one price to get consumers in the door, but then charge consumers much more after they\u2019ve invested time on the lot,\u201d said Brooks.<\/p>\n<p>Most of this deceptive advertising involves misrepresenting a car\u2019s full price, its monthly payment, or the dealership\u2019s affiliation with government programs, she added.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\">\n<div class=\"td-video-replacer\" data-id=\"undefined\"><\/div>\n<div class=\"youtube-embed\" data-video_id=\"5wUp-yOPsLg\"><iframe loading=\"lazy\" id=\"widget4\" title=\"New FTC CARS Rule Welcomed by Consumers and Dealers\" src=\"https:\/\/www.youtube.com\/embed\/5wUp-yOPsLg?feature=oembed&amp;enablejsapi=1\" width=\"100%\" height=\"392\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div><figcaption class=\"wp-element-caption\"><em>Jamie D. In 2020, the agency\u00a0<a href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/cases-proceedings\/x200041-202-3127-traffic-jam-events-llc-matter\">sued<\/a>\u00a0dealer ad agency Traffic Jam Events of Kenner, Louisiana for mailers which supposedly directed consumers to a COVID stimulus relief program site, the address of which was really a car lot.<\/p>\n<p>These tactics not only harm car buyers but dealers themselves \u201cwho have to beat the bogus prices of dishonest competitors,\u201d Brooks explained. \u201cWhen a dealership advertises low prices, people end up selecting that dealership over others under false pretenses.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/ethnicmediaservices.org\/wp-content\/uploads\/2023\/12\/FTC-cars-e1702923713176.png\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25710 td-animation-stack-type0-2\" src=\"https:\/\/ethnicmediaservices.org\/wp-content\/uploads\/2023\/12\/FTC-cars-1024x790.png\" alt=\"FTC car ad\" width=\"1024\" height=\"790\" \/><\/a><figcaption class=\"wp-element-caption\">An example of a \u201cbait-and-switch\u201d car ad.<\/figcaption><\/figure>\n<h2 class=\"wp-block-heading\">Junk fees, add-ons<\/h2>\n<p>Many of these pretenses also involve \u201cjunk fees\u201d for hidden add-ons \u2014 \u201clike extended warranties, car or asset protection, or coatings that are supposed to protect the car\u201d \u2014 which can easily cause unknowing buyers thousands of dollars, said Sanya Shahrasbi, an attorney with the FTC\u2019s Division of Financial Practices.<\/p>\n<p>\u201cIn the past two years alone,\u201d she continued, \u201cdealers have substantially increased prices for these add ons, even though such products and services largely are not constrained by supply.\u201d A 2022 FTC\u00a0<a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2022\/04\/ftc-takes-action-against-multistate-auto-dealer-napleton-sneaking-illegal-junk-fees-bills\">lawsuit<\/a>\u00a0against multistate dealer Napleton, the thirteenth-largest dealership group in the country, found that 83% or 16,848 of the dealer\u2019s customers were charged for add-ons that they didn\u2019t agree to; for instance, \u201cone consumer paid for a $2,000 service contract that the dealer said was free.\u201d<\/p>\n<p>This Napleton action found not only that buyers were being charged for add-ons they didn\u2019t agree to, but also that these buyers were disproportionately Black and Latino, added Mithal.\u00a0A 2023 action against Wisconsin-based dealer group\u00a0<a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2023\/10\/ftc-wisconsin-take-action-against-rhinelander-auto-center-illegally-discriminating-against-american\">Rhinelander Auto Center<\/a>\u00a0found analogous targeting of local Native American consumers.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\">\n<div class=\"td-video-replacer\" data-id=\"undefined\"><\/div>\n<div class=\"youtube-embed\" data-video_id=\"_IrY0Q4ix2A\"><iframe loading=\"lazy\" id=\"widget6\" title=\"Dishonest Car Dealers Cheat Consumers With Unnecessary Add-on Purchases\" src=\"https:\/\/www.youtube.com\/embed\/_IrY0Q4ix2A?feature=oembed&amp;enablejsapi=1\" width=\"100%\" height=\"392\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div><figcaption class=\"wp-element-caption\"><em>Sanya Shahrasbi, Attorney, Division of Financial Practices, Federal Trade Commission, explains how sneak junks fees that cost consumers thousands into car purchases.<\/em><\/figcaption><\/figure>\n<p>Much of the vulnerability of these racial and ethnic groups owes to language access obstructed by lengthy contracts hiding fees;
