{"id":7946,"date":"2018-06-26T21:25:03","date_gmt":"2018-06-27T04:25:03","guid":{"rendered":"https:\/\/lapost.us\/?p=7946"},"modified":"2018-06-26T21:32:52","modified_gmt":"2018-06-27T04:32:52","slug":"supreme-court-upholds-trump-travel-ban","status":"publish","type":"post","link":"https:\/\/lapost.us\/?p=7946","title":{"rendered":"Supreme Court Upholds Trump Muslim Travel Ban"},"content":{"rendered":"<div class=\"el__leafmedia el__leafmedia--sourced-paragraph\">\n<p class=\"zn-body__paragraph speakable\">The Supreme Court has\u00a0<a href=\"http:\/\/cdn.cnn.com\/cnn\/2018\/images\/06\/26\/travel.ban.pdf\">upheld President Donald Trump&#8217;s travel ban<\/a>.<\/p>\n<\/div>\n<div class=\"zn-body__paragraph speakable\">The ruling was 5-4 along partisan lines, with Chief Justice John Roberts writing for the conservative majority.<\/div>\n<div class=\"el__embedded el__embedded--standard\">\n<div class=\"el__storyelement--standard el__article--embed\">\n<div class=\"el__article--teaseimage\"><\/div>\n<\/div>\n<\/div>\n<div class=\"zn-body__paragraph speakable\">The ruling sends a strong message that Trump has broad powers under immigration law to act to protect national security and that statements made during a campaign may not be legally determinative of the President&#8217;s intent.<\/div>\n<div><\/div>\n<div class=\"zn-body__paragraph\">&#8220;The Proclamation is squarely within the scope of Presidential authority,&#8221; Roberts wrote.<\/div>\n<div>\n<div id=\"pb-root\" class=\"c o l l a p s e d - n a v\">\n<div data-role=\"close-tray\">\n<article class=\"grid container padded-container\">\n<section id=\"left\" class=\"left guttered width-100\">\n<div id=\"f0AWCErdziHtVq\" class=\"wrapper clearfix col full pb-feature pb-layout-item pb-f-article-body\" data-pb-name=\"Article Body (Elements)\" data-pb-curated=\"curated\">\n<div class=\"collection collection-cards\">\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>n a scathing dissent she summarized aloud in court, Justice Sonia Sotomayor said, &#8220;History will not look kindly on the court&#8217;s misguided decision today, nor should it.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Trump weighed in moments after the decision was announced on Twitter.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>\u201cSUPREME COURT UPHOLDS TRUMP TRAVEL BAN. Wow!\u201d he wrote.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>In a formal response, Trump hailed the decision as &#8220;a moment of profound vindication&#8221; following &#8220;months of hysterical commentary from the media and Democratic politicians who refuse to do what it takes to secure our border and our country.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Democrats maintained the policy wasn\u2019t about safety \u2014 it was about discrimination.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>\u201cThe Trump travel ban is a gross violation of our American values, and the Supreme Court&#8217;s ruling along partisan lines does nothing to change that,&#8221; Gov. Cuomo said. \u201cThis shameful and bigoted policy is nothing but a thinly veiled attempt to govern by hate and division and continue the federal government&#8217;s assault on immigrants.\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Rep. (James Keivom \/ New York Daily News)<\/div>\n<p><span class=\"sharebar \"><button class=\"button button-icon button-icon-hover-accent \" role=\"button\" name=\"twitter\" aria-label=\"share on twitter\" data-arctrack=\"socialShareTwtr\" data-referrer=\"\"><i class=\"fa fa-twitter button-icon-inset-accent\"><\/i><\/button>\u00a0<button class=\"button button-icon button-icon-hover-accent \" name=\"facebook\" aria-label=\"share on facebook\" data-arctrack=\"socialShareFb\" data-referrer=\"\"><i class=\"fa fa-facebook-square button-icon-inset-accent\"><\/i><\/button><\/span><\/p>\n<\/figcaption><\/figure>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Protests erupted at airports across the country last January as legal U.S. residents with green cards were taken into custody and others were detained after the order was unveiled.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>In the 17 months since the commander-in-chief signed off on the first decree, federal judges in Hawaii, California, Maryland and Virginia have all rejected various versions of the executive order as unconstitutional.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>The battle over the ban began in earnest when the first executive order was scuttled by lower courts. Months later, the second was allowed to partially go into effect by the Supreme Court last year. It expired in September.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>The current ban, which Trump has called a &#8220;watered-down&#8221; version, has been in effect since December and is designed to be permanent.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Much like its predecessors, travel ban 3.0 blocks almost all immigrants, visitors and refugees from five mainly Muslim countries as well as travelers from North Korea and government officials from Venezuela.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>The mostly-Muslim nations are Iran, Libya, Somalia, Syria and Yemen.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Justices Anthony Kennedy, Clarence Thomas, Samuel Alito and Neil Gorsuch joined Roberts in the majority with liberal Justices Stephen Breyer, Elena Kagan, Sonia Sotomayor and Ruth Bader Ginsburg dissenting.<\/p>\n<\/div>\n<\/div>\n<div class=\"card card-pull-center card-captioned collection-item\" data-type=\"image\">\n<div class=\" card-content \">\n<figure class=\"\">\n<div class=\"full-width img-container \"><img decoding=\"async\" class=\"b-lazy full-width b-loaded\" src=\"http:\/\/www.nydailynews.com\/resizer\/V2-_D8yEidzPsPFxZNhqpPG1oc0=\/1400x0\/www.trbimg.com\/img-5b2d0234\/turbine\/ny-1529676336-8ig0l9jpob-snap-image\" alt=\"The U.S. Supreme Court upheld President Trump's travel ban.\" \/><\/div><figcaption class=\"caption-text spaced spaced-top spaced-sm flex-container-row justify-space-between \">\n<div>The U.S. Supreme Court upheld President Trump&#8217;s travel ban. (Toya Sarno Jordan \/ Getty Images)<\/div>\n<p><span class=\"sharebar \"><button class=\"button button-icon button-icon-hover-accent \" role=\"button\" name=\"twitter\" aria-label=\"share on twitter\" data-arctrack=\"socialShareTwtr\" data-referrer=\"\"><i class=\"fa fa-twitter button-icon-inset-accent\"><\/i><\/button>\u00a0<button class=\"button button-icon button-icon-hover-accent \" name=\"facebook\" aria-label=\"share on facebook\" data-arctrack=\"socialShareFb\" data-referrer=\"\"><i class=\"fa fa-facebook-square button-icon-inset-accent\"><\/i><\/button><\/span><\/p>\n<\/figcaption><\/figure>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Sotomayor wrote in her dissent that based on the evidence in the case &#8220;a reasonable observer would conclude that the Proclamation was motivated by anti-Muslim animus.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>She said her colleagues arrived at the opposite result by &#8220;ignoring the facts, misconstruing our legal precedent, and turning a blind eye to the pain and suffering the Proclamation inflicts upon countless families and individuals, many of whom are United States citizens.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Roberts was careful not to endorse Trump&#8217;s provocative comments about immigration or Muslims in his opinion.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>&#8220;We express no view on the soundness of the policy,&#8221; Roberts wrote.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>However, much of the fight before the Supreme Court centered around the President\u2019s own Islamophobic comments on the campaign trail.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>Trump campaigned on calls to bar Muslims from entering the U.S. and made several incendiary statements about Islam.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item\" data-type=\"text\">\n<div class=\" card-content \">\n<p>&#8220;I think Islam hates us,&#8221; Trump said in 2016. \u201cThere\u2019s something there that \u2014 there\u2019s a tremendous hatred there.
